Voir dire is one of the most important aspects of any trial. Many attorneys feel that jury selection is the single most significant procedure in the entire trial process. The purpose of voir dire questioning is to deselect unfair and biased individuals. The deselection process in which prospective jurors are questioned and challenged for bias turns out to be a battle of wits and strategy.
The ultimate objective of voir dire is to ferret out the prejudice and bias that lurks in everyone's mind and heart. 'Jury selection' is a misnomer, it is really 'juror deselection'. Challenges for cause is the only way one can hope to obtain fungible jurors. With only a few peremptory challenges allotted, we merely eliminate those jurors that are unable to understand/perceive the critical issues of the case.
Jury deselection should never be a roll of the dice. Jury deselection is the only way one can seek a fungible jury verdict (justice). Justice is the interpretation and enforcement of the laws without favoritism (bias and/or preconceived opinions/feelings) or corruption (distortion and /or ulterior interests). |
